Yandex's Wonder app latest to be quashed by Facebook

Russian search giant Yandex is temporarily suspending the development of its Wonder social discovery app just one week after Facebook blocked the app's access to its API data.

The Wonder app was designed to synthesize information from a user's social networking activity on Facebook, Instagram, Foursquare and Twitter to provide answers to questions about places, music and news. Users could ask the app, for instance, which sushi restaurants their friends had gone to in New York, what types of music certain friends were listening to, or even news stories that had been shared by friends.

Though it was optional for users to connect the app with their preexisting network of Instagram, Foursquare and Twitter friends, it was mandatory for users to link the app to their Facebook accounts.

"Wonder's functioning, in its current state, as well as the quality of user experience it provides, largely depends on the access to Facebook's graph API," said Yandex spokesman Vladimir Isaev via email. "Since this access was revoked, we decided to put our application on hold for the time being."

Facebook blocked Wonder's access to its social API (application programming interface) within four hours of the app's beta launch to iOS users in the United States.

Wonder was built to offer users social search tools at a time when Facebook is making moves to stake its own claim in search. The social network launched its local-business discovery feature Nearby last year for its mobile app, and is in the process of rolling out its much-talked-about social Graph Search tool.

Many of the questions Graph Search is designed to answer -- such as, "Which Mexican restaurants are liked by my friends in San Francisco?" -- are strikingly similar to the types of queries intended for Wonder.

The Wonder shutdown is part of a larger issue tied to whether certain firms are allowed to access other social networks' API data. Last week, Twitter's new Vine mobile video app sparked lots of questions just hours after its launch when users discovered they were unable to access their Facebook friends through the service.

Facebook, in response, published an update to its platform policies in an effort to explain why it blocked the friend-search feature on Vine.

To explain Wonder's blocked access, Yandex's Isaev points to the same policies, in part stating that no data obtained from Facebook can be used in any search engine or directory without the company's written permission.

Christian school's lawsuit may test court ruling

LOS ANGELES (AP) -- A lawsuit by a Southern California Christian school against two former teachers who refused to provide proof of their faith could pose one of the first court tests of a U.S. Supreme Court ruling on religious freedom.

A legal expert said last year's ruling that religious workers can't sue for job discrimination never specified whether that includes teachers at religious schools.

Calvary Chapel of Thousand Oaks purchased Little Oaks School in 2009, and leaders told employees last year that they would need to provide a statement of faith and a reference from a pastor to renew their contracts.

The two teachers lost their jobs after refusing to provide the documents. After they threatened litigation, school leaders filed their own lawsuit in federal court in Ventura.

James A. Sonne, director of the Religious Liberty Clinic and a lecturer in law at Stanford University Law School, noted that the dispute comes just a year after the high court's ruling in the case of the Hosanna-Tabor Evangelical Lutheran Church and School of Redford, Mich., which holds that religious workers can't sue for job discrimination.

The court refused to specify in that ruling what constituted a religious worker, leaving teachers uncertain of their status under the law.

Sonne said the question remains whether teachers are performing "ministerial duties."

"Churches have First Amendment rights to choose their ministers," Sonne said. "The question is how does that apply outside the liturgical setting? The area where that will be played out is in the religious school context."

The school and its owner say their right to hire teachers who share their beliefs is protected by the California Constitution, the U.S. Constitution's right of the free exercise of religion, and civil rights laws.

The school is incorporated as a for-profit entity, but church leaders said the school is operated not as a profit-generating entity but as a spiritual arm of the church. About 130 students in preschool through fifth grade are taught there.

The teachers, Lynda Serrano and Mary Ellen Guevara, are citing the state's Fair Employment and Housing Act, which prohibits religious discrimination with exemptions that do not include for-profit religious groups.

Sonne said a constitutional ruling under federal law would most likely trump a state provision, which may be the reason the church filed in federal court.

"We're a Christian school," the Rev. Rob McCoy, pastor of the church and headmaster of the school, told the Ventura County Star. "We were coming to the point where we were establishing a Christian curriculum. We wanted to make sure teachers subscribed to that faith."

Serrano, once director of the preschool, had been with the school since 2006. Guevara was hired in 2011.

"They did not believe they should be required to obtain a pastoral reference in order to continue their employment," their attorney, Dawn Coulson, wrote in a letter to church leaders.

The teachers lost their jobs. In the letter from Coulson, they said they were prepared to sue and were asking for $150,000 apiece from the school to settle the case.

Instead of settling, church and school leaders filed a lawsuit in U.S. District Court, asking for an injunction that would prevent the teachers from filing their lawsuit in a different venue, the newspaper said. They wanted to make sure litigation took place in federal court.

Their suit names not only the two teachers but the law firm that represents them. It alleges the California Fair Employment and Housing Act is unconstitutional when used to restrict a religious school's hiring practices, even if the group is for-profit.

Stem cells boost heart's natural repair mechanisms

Jan. 29, 2013 ? Injecting specialized cardiac stem cells into a patient's heart rebuilds healthy tissue after a heart attack, but where do the new cells come from and how are they transformed into functional muscle?

Researchers at the Cedars-Sinai Heart Institute, whose clinical trial results in 2012 demonstrated that stem cell therapy reduces scarring and regenerates healthy tissue after a heart attack, now have found that the stem cell technique boosts production of existing adult heart cells (cardiomyocytes) and spurs recruitment of existing stem cells that mature into heart cells. The findings, from a laboratory animal study, are published in EMBO Molecular Medicine online.

"We're finding that the effect of stem cell therapy is indirect. It stimulates proliferation of dormant surviving host heart tissue, and it attracts stem cells already in the heart. The resultant new heart muscle is functional and durable, but the transplanted stem cells themselves do not last long," said Eduardo Marb?n, MD, PhD, director of the Heart Institute. Marb?n, the article's senior author, invented the experimental stem cell procedures and technology tested in humans.

Consistent with previous studies, the researchers found that the heart's native stem cells are not responsible for the normal replenishment of lost heart cells, but they do contribute to rebuilding heart tissue after heart attack.

This study shows that existing heart cells contribute to formation of new heart cells in the normal heart: Through a gradual cycling process, dying heart cells are replaced by new ones. The researchers found that this cycling process escalates in response to heart attack, enabling existing heart cells to assist in the development of new ones. Further, these effects can be amplified through stem cell therapy.

The investigational therapy turns on genes that bolster cell production from both sources -- existing heart cells and existing stem cells -- essentially boosting the heart's normal means of cell replacement and its natural responses to injury. The injection of stem cells also improves heart structure and function.

Marb?n and his clinical and research teams in 2009 performed the first procedure in which a heart attack patient's own heart tissue was used to grow specialized stem cells that were injected back into the heart. Earlier this year, they reported results of a clinical trial that found significant reduction in the size of heart attack-caused scars in patients who underwent the experimental stem cell procedure, compared to others who did not.

Although the preliminary results are positive, the researchers do not know precisely how the research treatment works.

"Understanding the cellular sources and mechanisms of heart regeneration is the first step toward refining our strategies to more effectively regenerate healthy tissue after heart attacks," said Marb?n, the Mark S. Siegel Family Professor.

The animal study was supported by National Institutes of Health grant R01 HL083109, the California Institute for Regenerative Medicine and the Cedars-Sinai Board of Governors Heart Stem Cell Center.

The process to grow cardiac-derived stem cells involved in the clinical trial was developed earlier by Marb?n when he was on the faculty of Johns Hopkins University. The university has filed for a patent on that intellectual property and has licensed it to Capricor Inc., a biotechnology company in which Dr. Marb?n is a founder and equity holder. The company provided no funding for this study.

Electoral vote plan divides Michigan GOP

Lansing ? Senate Majority Leader Randy Richardville said Tuesday he doesn't necessarily agree with a proposal to change the rule under which Michigan awards its 16 electoral votes to the presidential candidate winning the state's popular vote.

Rep. Pete Lund, R-Shelby Township, has said he planned to bring back a 2012 bill that would switch to a system by which the state divvies up 14 of its electoral votes according to which candidate gets the most votes in each congressional district. The last two votes would go to the winner of the statewide vote.

"I don't know that it's broken, so I don't know that I want to fix it," said Richardville, R-Monroe.

There are signs that talk of such a strategy is moderating among Republican politicians.

After initially seeming to say he was open to the plan, Gov. Rick Snyder disparaged it this week in a Bloomberg TV interview.

"I'm very skeptical of the idea and the time frame that would be done," Snyder said. "We don't want to change the playing field so it's an unfair advantage to someone. And in a lot of ways, we want to make sure we're reflecting the vote of the people, and this could challenge that."

He said the appropriate time to make a change would be before ? not just after ? a U.S. Census and the resulting congressional redistricting.

And he added it should be a bipartisan effort.

"I don't think this is the time to really look at it," Snyder said.

Democrats see the move as an unfair effort by the GOP to gain advantage after controlling redistricting in a state that the Democratic candidate for president has won since 1988.

The effort to change Electoral College rules had an initial surge of interest in states ? mostly in the Midwest ? where Obama captured all of the electoral votes to seal his 2012 victory but Republicans have held legislative majorities and other top elective offices for the past two years.

One analysis says if Lund's proposal had been in effect last year, Mitt Romney would have captured nine of Michigan's electoral votes despite losing statewide to President Barack Obama by nearly 450,000 votes.

The idea has been discussed in Ohio, Pennsylvania and Wisconsin, although there were reports Tuesday that Ohio's GOP is dropping the idea.

Virginia has legislation calling for the change, but Gov. Bob McDonnell has said publicly he thinks it's a bad idea.

Richardville argued Michigan's winner-take-all approach to awarding electoral votes gives the state more influence in choosing a president.

He said, however, he would take a look at any proposal coming over from the state House.

All but two states, Maine and Nebraska, are winner-take-all. Those two follow rules like the ones Lund proposes.

Lund has yet to introduce his proposal this year, but plans to do so. A bill he sponsored last year failed to gain support and died at the end of the legislative session.

Lund said now is the perfect time to debate the change because the next election is far off.

"We've got 45 weeks until it matters," he said. "I'm still going to do it but I'm not in a hurry; it's not a priority right now."

Mumbai: Borrowers could see better days ahead as banks are expected to cut lending rates following the Reserve Bank of India?s (RBI) decision to cut short-term lending rate as well as unlocking Rs18,000 crore by slashing cash reserve ratio (CRR) by 0.25%, reports PTI.

Soon after the Reserve Bank unveiled its mid-quarter review of the monetary policy, several bankers hinted that they may consider rate cut in their Asset Liability Committee (ALCO) meeting.

?

RBI governor D Subbarao in the third quarter monetary policy review surprised the market by cutting short-term lending rate called repo by 0.25% to 7.75% and CRR by similar margin to 4%, releasing Rs18,000 crore primary liquidity into the system.

?

Commenting on RBI?s action, SBI managing director A Krishna Kumar said ?a rate cut is likely. Rates on advances and deposits could come down simultaneously. The RBI?s action is positive?.

?

Indian Overseas Bank executive director AK Bansal said the RBI?s action will result in moderation of interest rates in the coming days. Both lending and deposit rates are expected to see a downward revision which will improve growth prospects, he said.

?

According to Canara Bank executive director AK Gupta, the bank would consider interest rate cut in the light of the RBI policy action.

?

Echoing similar views, Bank of India executive director N Seshadri said most of the banks are likely to transfer the rate cut. ?Full transmission will happen on both lending and deposit rates. A 0.25% cut is most likely.?

Tushar Poddar, managing director and chief India economist, Goldman Sachs, said, ?While the RBI?s action was ahead of market expectations, we were expecting it to ease more on repo rather than CRR. A front-loaded cut on the repo would have helped lower interest rates in the economy faster, in our view, and was justified by the downside surprises to inflation. The central bank, however, has taken the view that easing liquidity by cutting CRR will be of greater help in monetary transmission, and ease the growth process.?

Kotak Mahindra Bank chief economist Indranil Pan said RBI delivered a very balanced policy. ?As expected, they chose the calibrated path of a 25 basis points cut in the repo and the reverse repo rates. They wanted to avoid a repeat of April 2012 when the RBI had cut the repo rate by 50 basis points and then had to pause with surprises creeping in from the inflation side,? he said.

TUSTIN, Calif. (AP) ? The massive blimp-like aircraft flies but just barely, hovering only a dozen feet off a military hangar floor during flight testing south of Los Angeles.

Still, the fact that the hulking 230-foot-long Aeroscraft could fly for just a few minutes represents a step forward in aviation, according to the engineers who developed it. The Department of Defense and NASA have invested $35 million in the prototype because of its potential to one day carry more cargo than any other aircraft to disaster zones and forward military bases.

"I realized that I put a little dot in the line of aviation history. A little dot for something that has never been demonstrated before, now it's feasible," said flight control engineer Munir Jojo-Verge.

The airship is undergoing testing this month at Marine Corps Air Station in Tustin, and must go through several more rounds of flight testing before it could be used in a disaster zone or anywhere else. The first major flight test took place Jan. 3.

The biggest challenge for engineers is making sure the airship will be able to withstand high winds and other extreme weather conditions, Jojo-Verge said.

"Their vulnerability is their large size," said aviation expert and former Navy test pilot Pete Field. "There's a lot of surface area so wind affects it tremendously."

Worldwide Aeros, the company that developed the aircraft, said it also must secure more funding for the next round of flight tests, but is hopeful the Defense Department and others will step in again as investors.

The company says the cargo airship's potential to carry more cargo more efficiently than ever before would provide the U.S. military with an advantage on the battlefield and greater capacity to save more lives during natural disasters.

The lighter-than-air vehicle is not a blimp because it has a rigid structure made out of ultra-light carbon fiber and aluminum underneath its high-tech Mylar skin. Inside, balloons hold the helium that gives the vehicle lift. Unlike hydrogen, the gas used in the Hindenburg airship that crashed in 1937, helium is not flammable.

The airship functions like a submarine, releasing air to rise and taking in air to descend, said Aeros mechanical engineer Tim Kenny. It can take off vertically, like a helicopter, then change its buoyancy to become heavier than air for landing and unloading.

"It allows the vehicle to set down on the ground. And then when we want to become lighter than air, we release that air and then the vehicle floats and we can allow it to take off," Kenny said.

In the early 1930s, the Navy operated two airships ? the Macon and the Akron ? as flying aircraft carriers that could launch and retrieve biplanes. Both were lost to thunderstorms.

If the design team can make the Aeroscraft steady and maneuverable, it would be the ultimate logistics and transport vehicle, carrying tanks, equipment and supplies to bases around the world, Field said.

"I don't think there's much doubt about whether it's going to work or not. It's physics," he said. "In the right atmospheric conditions, it would be ideal."

The project has set abuzz the old hangars at the Marine Corps Air Station in Tustin. The structures were built to hold blimps during World War II. Now workers zip around in cherry-pickers, and the airship's silvery surface shines against the warm tones of the aging wood of the walls.

"You could take this vehicle and go to destinations that have been destroyed, where there's no ports, no runways, stuff like that. This vehicle could go in there, offload the cargo even if there's no infrastructure, no landing site for it to land on, this vehicle can unload its whole payload," said Kenny.

The prototype isn't intended to carry cargo, though a similar-sized craft could haul about 30 tons. Aeros wants to build a full-size 450-foot-long vehicle that can carry 66 tons of payload.

(AP) ? President Barack Obama said he'll sign a $50.5 billion emergency relief measure for Superstorm Sandy victims as soon as it lands on his desk.

Three months after Sandy ravaged coastal areas in much of the Northeast, Obama chided lawmakers for taking their time to approve the funding even as he commended them for providing the long-awaited aid.

"So while I had hoped Congress would provide this aid sooner, I applaud the lawmakers from both parties who helped shepherd this important package though," Obama said in a statement late Monday.

Despite opposition from conservatives concerned about adding billions of dollars to the nation's debt, the Senate cleared the bill, 62-36, after House Republicans had stripped it earlier this month of spending unrelated to disasters.

"This is a huge relief," said Sen. Charles Schumer, D-N.Y.

Northeast lawmakers said the money is urgently needed to start rebuilding homes, businesses, public transportation facilities and other infrastructure damaged by the Oct. 29 storm, one of the worst to strike the Northeast. Sandy is blamed for more than 130 deaths in the U.S. and tens of billions of dollars in property damages, particularly in New York and New Jersey.

The measure is aimed primarily at helping residents and businesses as well as state and local governments rebuild from the storm. The biggest chunk of money is $16 billion for Housing and Urban Development Department community block grants. Of that, about $12.1 billion will be shared among Sandy victims as well as those from other federally declared disasters in 2011-13. The remaining $3.9 billion is solely for Sandy-related projects.

More than $11 billion will go to the Federal Emergency Management Agency's disaster relief aid fund for Sandy and other disasters. Another $10 billion is devoted to repairing New York and New Jersey transit systems.

Earlier in January, Congress approved and Obama signed a $9.7 billion bill to replenish the National Flood Insurance Program, which has received well over 100,000 claims related to Sandy. Added to the new, $50.5 billion package, the total is roughly in line with the $60.4 billion Obama requested in December.

The aid package was greased for passage before the last Congress adjourned and the new one came in on Jan. 3. But Speaker John Boehner refused to bring it to the floor after two-thirds of House Republicans voted against a "fiscal cliff" deficit-reduction deal raising taxes on couples making more than $450,000 a year while deferring some $24 billion in spending cuts in defense and domestic programs.

The ruckus after the Senate had passed an earlier $60.4 billion Sandy relief package by a nearly 2-to-1 margin on Dec. 28 exposed deep political divisions within Republican ranks. "There's only one group to blame for the continued suffering of these innocent victims: the House majority and their speaker, John Boehner," Republican New Jersey Gov. Chris Christie fumed at the time.

Top House Republicans responded by bringing new Sandy aid legislation to the floor under ground rules designed to win over as many Republicans as possible while retaining support from Democrats eager to approve as much in disaster aid as possible.

GOP leaders cut spending in the Senate bill unrelated to disasters. One was to transfer $1 billion from training programs for Iraqi policemen to bolstering security at U.S. diplomatic missions. The shift in money followed a Sept. 11 terrorist attack on the American consulate in Benghazi, Libya.

Also deleted was $188 million for an Amtrak expansion project that included new, long-planned tunnels from New Jersey to Penn Station in Manhattan.

As with past natural disasters, the Sandy aid bill is not offset with spending cuts, meaning the aid adds to the deficit. The lone exception is an offset provision requiring that $3.4 billion for Army Corps of Engineers projects to protect against future storms be covered by an equal amount of unspecified spending cuts in other programs before next October.

The Senate on Monday rejected, 35-62, an attempt by conservatives to amend the final package with an offset provision to cut federal programs across the board by one-half of 1 percent through 2021.

Can anyone sue to stop an effort to change how electoral votes are allocated in swing states? Lyle Denniston examines the constitutional arguments about a contentious issue.

The statement at issue:

?We have been documenting?what appears to be a coordinated effort by Republicans in a number of key states to change the rules for electing a president.? To change the rules so essentially Democrats running for president cannot win?.Virginia Republicans are using the same maps they have gerrymandered for a permanent Republican advantage at the state level to also distribute Virginia?s Electoral College votes when it comes to voting for president?.The action in Virginia is the first of its kind in the nation.? What we have been covering is Republicans making noises about doing this across the country wherever they can?not just in Virginia, but in Wisconsin and Michigan and Ohio and Pennsylvania.?

We checked the Constitution, and?

checkForty-eight states (all but Maine and Nebraska) for years have been using a system in presidential elections under which the winner of their statewide popular votes gets all of their allotted votes in the Electoral College system.?? It is the closest thing to a direct popular vote method of choosing presidents, without getting rid of the Electoral College altogether.? But, under the Constitution, it seems pretty clear that the states don?t have to do it that way, or so the Supreme Court has said.

What MSNBC?s Rachel Maddow has come across is a budding effort by Republican-controlled legislatures in a number of states that often figure as ?battleground states? in the presidential campaign, to switch from winner-take-all to winner-by-congressional-district in picking presidential electors.? That?s the method Maine and Nebraska now use.

What difference would it make?

Maddow makes this point: ?If the system Virginia Republicans are pushing now had been in place in 2012, Barack Obama would still have received 150,000 more votes than Mitt Romney in 2012 in Virginia, but the Electoral College vote from Virginia would have been four votes for Barack Obama and nine votes for Mitt Romney.?

In an earliest broadcast on this same tactic, Maddow made the point that, if a switch to district-by-district Electoral College voting had been made for key ?battleground states? in 2012, ?President Obama would have finished the election nationwide with 5 million more votes than Mitt Romney, but Mitt Romney would have still won the Electoral College and won the presidency.?

Two constitutional points emerge immediately.?? First, the Constitution does not guarantee that presidents will be chosen by popular vote; the Electoral College is not designed that way.? It still astounds even well-educated people when they are reminded that they do not vote for the president; they vote for presidential electors, who usually vote for the candidate they represent, but they are not bound to do so.

And, second, if there is no promise of a popular vote, there is no constitutional problem with the second-place finisher in that vote winning the presidency; it has happened several times ? most recently, in 2000, when George W. Bush got about 543,000 fewer votes nationwide than Al Gore, but achieved victory in the Electoral College.

But the most significant constitutional point is that the Supreme Court, beginning with a decision in 1892 (in the case of McPherson v. Blacker), has said repeatedly that there is no command that the states choose their presidential electors in one way only.?? The 1892 ruling, in fact, upheld a decision by the Michigan legislature to switch from a winner-take-all to a district-by-district system.? And the core principle of that decision ? that it is up to the states to choose the method ? was reaffirmed by the Court in its decision in Bush v. Gore.

The heart of the concern expressed by Rachel Maddow, of course, was not a constitutional one: she was making the political argument that legislatures should not frustrate the choice that a majority of the state?s voters made at the ballot box, and that doing so would result from partisan gerrymandering of congressional districts after the 2010 elections.

But suppose that the legislatures in formerly ?battleground states? do succeed in switching their states to district-by-district choice of presidential electors.? Could anybody sue to challenge that constitutionally?

The simple answer, and the answer that perhaps has the longest historical pedigree, seems to be no.?? Who can claim injury, and thus have a viable legal point, if the Constitution allows a switch to a district system?? Could the popular vote winner in a state claim injury?? If the popular vote winner were a Democrat, say, could that party sue, or could some individual voter who cast a ballot for the Democratic candidate claim that his or her vote didn?t count?

If partisan gerrymandering of congressional districts is not a constitutional problem on its own (and the Supreme Court has been unwilling so far to say that it is a problem), then the fact that a legislature did move to a district system explicitly to favor the nominee of one party might seem to be immune to a challenge on that ground.

So, what?s left??? The only avenue for a lawsuit against a district system may well be a variation on one that worked in 2012 in several lawsuits challenging alleged voter-suppression efforts by Republican officials.? That is a claim that election laws may not be written, or enforced, in a way that denies voters equal opportunity to vote, and to have their votes counted equally.?? In those cases, the voters complaining of barriers were minority voters, but there may be a broader principle at work.

The Supreme Court, in a 1986 decision involving the exclusion of a minor party from the presidential elector ballot in Ohio, ruled that it is unconstitutional under the Fourteenth Amendment to put a burden on ?the right of individuals to associate for the advancement of political beliefs.??? That hints at a right to sue, by members of a political party, to challenge a system that, in practical terms, undermines their right to collectively make a political choice.

Lawyers are creative people, and lawyers who specialize in election law have very rich legal imaginations.? Thus, it is not beyond contemplation that a lawsuit might be put together to challenge a switch to a districting system when that is done ? and is proved to be so ? to guarantee that one party?s nominee will prevail no matter how the statewide vote went.

True, such a claim is fairly close to a partisan gerrymandering argument.? And, of course, it would threaten the states? broad constitutional power to choose how to pick electors.? But it just might have a measure of plausibility to it.

Creativity site 99U suggests one way to better handle negative feedback is to start asking questions that will lead to a real solution.

Getting feedback is tough, and it's incredibly easy to fall into a defensive or aggressive trap when someone doesn't like what you're doing. If you really want to make the most out of the experience, you need to find a solution to make it better. One way of doing that is to ask the right kind of questions:

To ask a solution-focused question, describe a potential solution and ask whether it would be acceptable to the other person. For example, to get a piece of work accepted in its current form, you might ask:

"I know you don't like the look of it, but if I can show you evidence that your customers prefer it this way, will you sign it off?"

Your goal is to leave the room with a clearly-agreed next step towards a solution. They may still be sceptical or unsure, but at least you know what you need to do to get the work accepted.

A look at notable deadly nightclub fires

A fire that swept through a crowded nightclub in southern Brazil early Sunday appears to be the deadliest in a decade. Here is a look at some other recent big nightclub fires:

? A blaze at the Lame Horse nightclub in Perm, Russia, broke out in December 2009, when an indoor fireworks display ignited a plastic ceiling decorated with branches, killing 152.

? A fire at the Santika nightclub in Bangkok killed 67 people on New Year's Day in 2009. An indoor fireworks display set off after the countdown to the new year ignited the blaze.

?Fireworks sparked a blaze and stampede that killed at least 43 people at a Shenzhen, China nightclub in September 2008.

? A December 2004 fire killed 194 people at an overcrowded working-class nightclub in Buenos Aires, Argentina, after a flare ignited ceiling foam.

? A nightclub fire in the U.S. state of Rhode Island in 2003 killed 100 people after pyrotechnics used as a stage prop by the 1980s rock band Great White set ablaze cheap soundproofing foam on the walls and ceiling.

?Flames engulfed the tiny La Gojira discotheque in Caracas, Venezuela, in November 2002, leaving 50 people dead.

(AP) ? Marine experts say a dolphin seen shaking black gunk from its snout after wandering into a polluted canal in New York may well have been ill before it lost its way and died.

The wayward dolphin splashed around in the filthy waters of the Gowanus Canal before it died Friday. The canal is a Superfund site, where for years factories and fuel refineries operated. It runs through an industrial zone near some of Brooklyn's wealthiest neighborhoods.

Marine experts had planned to help the dolphin on Saturday morning if it didn't get out of the canal during high tide. They had decided to hold off intervening Friday because of the stress the dolphin might have experienced in being captured.

Experts plan to conduct a necropsy to determine why the dolphin died.

The Virgin Diet | Sarah Fit

Catchy title right? Author JJ Virgin explains how dropping 7 foods can help you lose 7 lbs in just 7 days in her new diet book, The Virgin Diet. I?m usually hesitant to review a diet book since many are boring, rarely groundbreaking or just plain against my own beliefs. After learning this book was about discovering your personal food intolerance, I was eager to give to it a look.

Virgin, a?25-year veteran of the health and fitness industry,?claims that common ?diet? foods are actually what is causing you to gain weight and not be able to take it off and food intolerance is to blame. The 7 foods most likely to cause food intolerance (or high-FI foods as she calls them) are gluten, soy, dairy, eggs, corn, peanuts and sugar and artificial sweeteners. While she doesn?t say these foods are off limits for everyone indefinitely, she suggests through listing symptoms that you may be intolerant to one or more of them and never have realized it before.

She goes into more details about why these high-FI foods can lead to weight gain, how to remove them from your diet, the false advertising behind such ?healthy? foods as soy and non-fat dairy, why moderation will make you fat, how to maintain a healthy diet without high-FI foods and how to test which ones are particularly bad for your unique biological profile.

The Good:

I found this book to be so interesting that I couldn?t wait to read certain chapters and finished in record time. I believe that the author doesn?t think most of the above foods are necessarily bad for you but that due to how it gets put on our table is. From chickens being fed a soy diet to stripping the fat from dairy products and rGHB hormones fed to the cows, the food we eat today is drastically different from what we did 100 years ago. I found the studies to be so interesting and made me want to eat only free range, grass-fed animal products.

The case against gluten, corn and peanuts is a whole other ball game placing blame basically on our government for not looking out for our well-being. I can live most easily without these three. As for sugar, I?m convinced I?m addicted and her chapter on it proved this is probably true however, I?m a healthy weight and an active individual. I?ll quit it when I?m ready and in my 20?s, I?m not ready. She does agree though that we are predisposed to certain tastes. Some of us have a sweet tooth and she agrees it can be genetic but says not to use that as an excuse. Instead, feed your sweet tooth with nut butters, fruit, cinnamon, vanilla, coconut, dark chocolate and even chocolate protein powder.

There are some but not many recipes in the book. She wants you to use her favorite food suggestions and be creative. I like this approach but some people may not. The recipes do not include nutrition information as the diet is not about counting calories.

The Rest of The Book?

She asks the reader to eliminate the 7 foods for 21-days. No slip ups. This is all or nothing 21 day elimination phase! If you accidentally eat something like soy, she wants you to wait at least another 21 days before introducing it back into your diet. After the first phase, you slowly reintroduce one food group a week at a time to see if in fact you may be intolerant to it. The four foods you are allowed to reincorporate into your diet are soy, gluten, dairy and eggs.?However, it?s not like it?s time to go binge on fro-yo the week you?re allowed to reintroduce dairy. You get to have one greek yogurt a day for 4 days. Then you eliminate it again for the next three to see how you feel. The following week, you keep dairy out again and this time try it with gluten. If you experience no symptoms, at the end of the 4 week phase 2, you can eat the foods during Phase 3 or rather? life. As for corn, peanuts and sugar she says to avoid it for the most part if you can indefinitely.

She is cool with xylitol and a little stevia as long as it?s mixed with xylitol. After after phase two, if you must have something like a cupcake, she says only have a max of three bites. She doesn?t mention chewing gum anywhere which makes me think it?s off-limits forever thanks to artificial sweetener.

She mentions alcohol is OK in the third phase, once in a celebratory moment. She also mentions not to juice carrots but never mentions any green juices or her thoughts on those. When it comes to being a vegan, she also suggests that it is not exactly the most healthy diet, but does cover how to do her diet if you are.

She recommends 3 meals a day with potentially one snack eating every 4-6 hours. I think this is a little long. She prefers no snack at all but understands if you are an early riser, it may be essential. I am a steadfast believer in the 4 pm snack.

My Takeaway

This is a great quick read for anyone that ?eats healthy,? exercises and still cannot lose weight. It?s also a great book if you are like me and enjoy learning about nutrition sciences. I do wish it wasn?t such an all or nothing entry point to try out but if you think you may have one of the food sensitivities, it?s worth a shot. I really do think people are adversely effect by high-FI foods and never realize it. Some of the symptoms she includes are acne, food cravings, asthma, arthritis, ADD, depression, constipation, psoriasis, throat cleaning, gas, bloating and chronic mucus/stuffy nose.

Final Grade: B+

100-mph winds halt search for Antarctica plane

A plane carrying three Canadians has gone missing in Antarctica. NBCNews.com's Dara Brown reports.

Howling winds and snow grounded an effort Thursday to find a small plane missing in a mountainous area of Antarctica for more than two days, rescuers said.

The twin-engine plane, carrying three Canadian crew members, was about an hour into a flight from the U.S.-run Amundsen-Scott South Pole Station to an Italian research station at Terra Nova Bay, when its emergency beacon was heard by rescue officials in New Zealand at about 4 a.m. ET Tuesday.

The company that owns the plane,?Kenn Borek Air Ltd.?of Calgary, Alberta, said it was ?maintaining a respectful silence? until the fate of the plane and its crew was known.

The?Calgary Sun?newspaper identified one of those aboard the plane as Bob Heath of the Northwest Territories, calling him a ?star pilot? for Kenn Borek Air.

The newspaper quoted Heath?s wife Lucy Heath as saying she was ?worried? and ?waiting for news.?

A search plane spent about five hours circling over the site of the beacon, which is in a mountainous area, but heavy cloud cover hampered the search and then the weather got worse, officials said.

Winds have topped 100 mph and it was also snowing, Michael Flyger, spokesman for New Zealand?s?Rescue Coordination Center, said.

He added he hoped the next weather forecast "will bring good news,? enabling the search to continue.

Five-day water supply
The beacon?s signal is coming from an area about 11,000 feet above sea level, Flyger said.

?It?s pretty mountainous terrain. It?s impossible to say whether it crashed or made an emergency landing or they had a mechanical problem and had to ditch the plane,? he said. ?At the moment we have a plane that?s not where it should be and a locator beacon is going off.?

The beacon can be switched on manually, but it also would begin transmitting if sensors detected a crash, Flyger said.

Despite the conditions in the area, there may be reason for optimism, he added.

?We do know that onboard the aircraft there was a significant amount of survival equipment -- heavy-duty mountain tents, enough water for three people for five days,? he said. ?They?ve certainly got the equipment to look after themselves.?

The National Science Foundation, which manages the U.S. Antarctic Program, said the plane was flying in support of Italian Antarctic research.

Searchers from the United States, Italy and Canada are assisting in New Zealand's efforts and have helicopters and airplanes ready to return to the site, Flyger said, adding that the the ideal scenario would be for a helicopter to either land or use a winch to bring up survivors.

?If conditions are good enough, hopefully we can land a short distance away and the team will walk to the crash site,? he said. ??There?s some frustration that the weather has been the way it?s been. The searchers are very keen to get in and crack on with the job."
